New energy market integrity and transparency rules

Two important sets of rules aimed at making energy markets more transparent and fairer have been published in the Official Journal of the European Union.

One set of rules, a Delegated Regulation on inside information platforms and registered reporting mechanisms, relates to the procedure for authorisation, the withdrawal thereof and the supervision of entities that report energy market data to the EU Agency for the Cooperation of Energy Regulators (ACER). The goal is to make sure that the process for authorizing and overseeing these entities is straightforward and fair.

The other set of rules, repealing the Implementing Regulation (EU) 1348/2014 on data reporting, involves improving how energy market data is reported to ACER, enabling the latter to better monitor wholesale energy markets and detect potential market abuses. It aims to set out a balanced framework for market participants to provide data to ACER, easing the reporting burdens of market participants where possible.

These rules will enter into force on 29 April 2026. Once entered into force, there will be a transition period regarding the applicability of most of their provisions to give market participants and other relevant actors time to adjust to the changes introduced.

Background

These rules have been adopted under Regulation (EU) 1227/2011 on Wholesale Energy Market Integrity and Transparency (REMIT), as amended in 2024, which ensures agile monitoring of and transparency in wholesale energy market, and prevention of market manipulation.
